Terms and Conditions of Carriage

Welcome aboard Umoja Airways! These Terms and Conditions of Carriage ("Terms") govern the contract of carriage between you (the "Passenger") and Umoja Airways, Inc. ("Umoja Airways") for your flight reservation. Please read these Terms carefully before booking your flight.

1. Acceptance of Terms and Conditions: By purchasing a Umoja Airways ticket or using our services, you agree to be bound by these Terms. You confirm that you have the legal capacity to enter into this contract. If you do not agree to these Terms, you may not purchase a ticket or use our services.

2. Definitions: Baggage: Includes checked and unchecked baggage carried by the Passenger. Carrier: Umoja Airways, Inc. and any other air carrier transporting the Passenger pursuant to this agreement. Checked Baggage: Baggage accepted by Umoja Airways for carriage in the hold of the aircraft. Passenger: The person entitled to travel under a valid Umoja Airways ticket. 3. Fare, Taxes, and Fees: The fare for your flight is determined by the fare type you purchase and any applicable taxes and fees. All taxes and fees, including government-imposed taxes, airport charges, and fuel surcharges, are the responsibility of the Passenger and are not included in the advertised fare unless expressly stated. Fares and fees are subject to change without notice. Once purchased, all fares and fees are non-refundable unless otherwise stated in these Terms or applicable law.

4. Ticket Validity and Use: Your ticket is valid for travel only on the flight(s) and date(s) specified thereon. Your ticket is non-transferable and not refundable unless otherwise stated in these Terms or applicable law. You must present your valid ticket and a valid government-issued identification document to be permitted to board the flight. Failure to comply with these requirements may result in denial of boarding without refund.

5. Baggage: Umoja Airways has baggage allowance restrictions for both checked and unchecked baggage. Please refer to our website for current baggage allowances and fees. Any baggage exceeding the permitted allowance will be subject to additional charges. Umoja Airways is not liable for any loss or damage to your baggage unless caused by its negligence or willful misconduct. We strongly recommend purchasing travel insurance to cover potential baggage loss or damage.

6. Changes and Cancellations: Changes to your flight reservation may be made subject to availability and applicable fees. Please refer to our website or contact our customer service for more information. Cancellations will incur fees based on the fare type purchased and time remaining before departure. Please refer to our website for our cancellation policy. Umoja Airways reserves the right to cancel or reschedule flights due to weather, safety concerns, or other operational reasons. In such cases, we will endeavor to offer you alternative travel arrangements or a refund.

7. Conduct of Passengers: Passengers must comply with all applicable laws and regulations, including aviation security regulations. Passengers must behave in a responsible and courteous manner towards the crew and other passengers. Passengers are prohibited from engaging in disruptive or offensive behavior, including smoking, excessive[GA1] consumption of alcohol, or using illegal drugs. Failure to comply with these requirements may result in denial of boarding or removal from the flight without refund.

8. Liability: Umoja Airways' liability for death or injury to passengers is limited as provided by the Montreal Convention of 1999.[GA2] Umoja Airways is not liable for any loss or damage to your personal belongings unless caused by its negligence or willful misconduct.[GA3] [GA4] We recommend purchasing travel insurance to cover potential personal belongings loss or damage.

9. Governing Law and Dispute Resolution: These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Delaware, United States of America.

10. Force Majeure: Umoja Airways is not liable for any delay, cancellation, or other non-performance caused by events beyond its reasonable control, such as acts of God, natural disasters, strikes, wars, or government actions.

11. Amendment and Modifications: Umoja Airways reserves the right to amend these Terms at anytime without prior notice. The most current version of these Terms will be posted on our website.
